• Visit History: Dates visited, dishes consumed, chef notes, spend per visit
• Communication Records: Messages sent through the App’s Message Mui feature
• AI Concierge Conversations: All messages exchanged with our AI concierge
• Device & Usage Data: Check-in scan records, app activity logs, device identifiers
• Profile Photo: An optional photo you upload to your member profile

3. How We Use Your Information

We use your personal information for the following purposes:

• Membership Management: To create and manage your member account, track tier status and merit points, and administer benefits
• Personalization: To tailor your dining experience, including remembering preferences, dietary needs, and seating preferences
• AI Concierge Services: To provide intelligent, context-aware responses through our AI-powered concierge
• Event Management: To process event reservations, manage RSVPs, and communicate event updates
• Communication: To send booking confirmations, membership updates, event invitations, and promotional communications (with your consent)
• Service Improvement: To understand how members use our App and improve our services, features, and offerings
• Safety & Compliance: To comply with legal obligations and enforce our Terms of Service

4. AI Concierge Disclosure

The Mui AI Concierge is powered by OpenAI’s GPT technology. When you interact with the AI Concierge:

• Your messages and relevant profile context (such as dietary preferences and visit history) are transmitted to OpenAI’s API for processing
• OpenAI processes your data in accordance with their Privacy Policy and API data usage policies
• OpenAI does not use data submitted through the API to train their models by default
• Conversations with the AI Concierge are stored in our systems and may be reviewed by Mui staff for quality assurance and service improvement

5. Data Sharing & Disclosure

We do not sell your personal information to third parties. We may share your information with:

• Service Providers: Third-party vendors who help us operate the App (e.g., OpenAI for AI services, Twilio for SMS verification, email delivery services), bound by confidentiality agreements
• Legal Requirements: When required by law, court order, or governmental authority
• Business Transfers: In connection with a merger, acquisition, or sale of assets, subject to standard confidentiality protections
• With Your Consent: For any other purpose with your explicit consent

We do not share your personal information with restaurants, advertisers, or marketing partners outside of Mui Supper Club.

6. SMS & Text Messaging

If you choose to verify your account via phone number, we use Twilio, a third-party communications provider, to deliver SMS text messages to your mobile device. By opting to receive verification codes via SMS, you consent to the following:

• Your phone number will be shared with Twilio solely for the purpose of delivering text messages on our behalf
• Twilio processes your phone number in accordance with their Privacy Policy
• Message and data rates may apply depending on your mobile carrier and plan
• Message frequency varies with your requests and bookings; verification codes are sent only when requested
• You may opt out of SMS verification at any time by switching to email verification

• We will not use your phone number for marketing or promotional texts without your separate, explicit consent

Your phone number is stored securely in our system and is not sold or shared with any third parties beyond what is necessary to deliver the SMS service.

7. Data Retention

We retain your personal information for as long as your membership account is active. Upon account deletion, we will delete or anonymize your personal information within 30 days, except where retention is required by law or for legitimate business purposes (such as resolving disputes or fraud prevention). Transaction records may be retained for up to 7 years for tax and accounting compliance.

8. Data Security

We implement appropriate technical and organizational security measures to protect your personal information against unauthorized access, alteration, disclosure, or destruction. These measures include encrypted data transmission, access controls, and regular security reviews. However, no method of internet transmission or electronic storage is 100% secure.

9. Your Rights (CCPA & General Privacy)

Depending on your location, you may have the following rights regarding your personal information:

11. Children’s Privacy

The App is intended for adults aged 21 and over. We do not knowingly collect personal information from individuals under 21. If you believe we have inadvertently collected such information, please contact us immediately.

1. Acceptance of Terms

By downloading, accessing, or using the Mui Supper Club mobile application (the “App”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, please do not use the App. These Terms constitute a legally binding agreement between you and Mui Supper Club (“Mui”, “we”, “us”, or “our”).

2. Membership

Membership in the Mui Supper Club loyalty program is subject to the following:

• Eligibility: Membership is available to individuals aged 21 and over
• Tiers: Membership tiers (Seeker, Cultivator, Harmonist, Sage, and Mui Master) are determined by accumulated Mui Merit Points earned by checking in at the restaurant and at events
• Merit Point Earning: Merit points are earned by checking in at the restaurant and at events. The number of points awarded is subject to change at Mui’s discretion
• Benefits: Membership benefits associated with each tier are subject to change without prior notice at our sole discretion
• Non-Transferability: Membership accounts and accumulated merit points are personal and non-transferable
• No Cash Value: Merit points and tier status have no cash value and cannot be redeemed for cash

3. Event Bookings & Cancellation Policy

The following terms apply to event reservations made through the App:

• Reservation Requests: Submitting an RSVP through the App constitutes a reservation request, not a confirmed booking. All reservations are subject to staff confirmation
• Cancellation Deadline: Cancellations must be made at least 48 hours prior to the event start time. Late cancellations may result in forfeiture of any deposit or booking fee
• No-Shows: Failure to attend a reserved event without prior cancellation may result in temporary suspension of booking privileges
• Event Modifications: Mui reserves the right to modify, postpone, or cancel events at any time. In the event of a cancellation by Mui, guests will be notified and any fees paid will be refunded or credited

4. AI Concierge Disclaimer

The Mui AI Concierge is provided as a convenience feature to assist with general inquiries about Mui Supper Club. You acknowledge and agree that:

• Responses generated by the AI Concierge are for informational purposes only and may not always be accurate, complete, current, or appropriate to your specific situation
• The AI Concierge does not represent the official views, commitments, or policies of Mui Supper Club
• Any information provided by the AI regarding reservations, pricing, menu items, allergens, event availability, or hours should be independently confirmed with our staff before relying upon it
• Mui Supper Club is not liable for any actions taken, decisions made, or losses incurred based on AI Concierge responses

5. Food & Allergen Advisory

Mui Supper Club serves dishes that may contain or come into contact with common allergens including, but not limited to: fish, shellfish, crustaceans, tree nuts, peanuts, sesame, soy, wheat/gluten, eggs, and dairy. Some dishes may contain raw or undercooked ingredients.

It is your responsibility to inform our staff of any food allergies, intolerances, or dietary restrictions prior to your visit. While we will make every reasonable effort to accommodate your needs, Mui Supper Club cannot guarantee a completely allergen-free environment. Guests dine at their own risk with respect to food allergies and intolerances not disclosed to staff.

Consuming raw or undercooked foods may increase the risk of foodborne illness, particularly for pregnant individuals, the elderly, young children, and those with compromised immune systems.

6. Limitation of Liability

To the fullest extent permitted by applicable law, Mui Supper Club, its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App or participation in our membership program, including but not limited to loss of data, loss of merit points, or dissatisfaction with AI-generated content.

Our total liability to you for any claims arising under these Terms shall not exceed the amount you have paid to Mui Supper Club in the 12 months preceding the claim.

7. SMS & Text Messaging Consent

When signing up with a phone number, you can consent to text messages from Mui Supper Club using the separate, initially unchecked SMS consent box. These messages may include:

• Verification Codes: One-time passcodes to verify your identity during sign-up or sign-in
• Account Notifications: Important updates about your membership, bookings, or account security
• Customer Service: Responses and updates about your requests

Choosing phone sign-in and selecting Continue requests a verification code only; it does not enroll you in other messages. Message and data rates may apply. Message frequency varies with your requests and bookings. SMS consent is not a condition of purchase or membership; email verification is available. Carriers are not liable for delayed or undelivered messages. By consenting to receive texts, you confirm that you are the account holder of the phone number provided or have authorization from the account holder.

8. Privacy

Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the App, you consent to the collection and use of your information as described in the Privacy Policy. You may view our full Privacy Policy in the Settings section of the App.

9. Prohibited Conduct

You agree not to: (a) use the App for any unlawful purpose; (b) attempt to reverse-engineer, hack, or gain unauthorized access to our systems; (c) submit false, misleading, or fraudulent information; (d) impersonate another person or entity; or (e) use the App in any manner that could damage, disable, or impair our services.

10. Modifications to Terms

Mui Supper Club reserves the right to modify these Terms at any time. We will provide notice of material changes by updating the “Last Updated” date and, where appropriate, by notifying you through the App. Your continued use of the App after changes are posted constitutes your acceptance of the updated Terms.

11. Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved in the state or federal courts located in Los Angeles County, California.
